Terms and Conditions

1. The Agreement between you and Tichelaar Institute

We have sent you an email (sometimes other forms of communication) setting out what we propose as the basis upon which will assist you in your language course, including how many lessons and what the costs will be and by telling us that you wish to proceed, that creates an agreement between us. In these Terms and Conditions, we set out briefly what this agreement means for you.

2. Payments

We usually have set out in our email our payment terms, but every student will need to pay in advance of each block of lessons, unless otherwise discussed. The detailed terms of payment will usually be in the email we send you.

As a small business wishing to help many students, it is important to us that you pay on time. If you do not, we are afraid that the lessons cannot be held. If you are having financial difficulties, please contact our administrator Ann and she may be able to arrange to modify these terms.

If without agreement, invoices have not been paid on time, then regrettably we have to charge interest at 4% over the Base Lending Rate.

3. Cancellations, rescheduling and stopping/pausing lessons

We have a 48-hour cancellation policy. If students wish to stop or pause lessons, they should give us 4 weeks' notice and we offer no refunds if students abruptly have to stop or pause lessons (due to whatever circumstance).
 

If lessons are cancelled due to illness, we regard this lesson as a cancelled lesson, but these lessons can be postponed at no extra cost, but only if the lesson is cancelled due to sickness. 
 

If a lesson is cancelled due to the illness of one of our teachers, we try to accommodate the lesson with a different teacher. These lessons can be postponed but not refunded (or deducted from the next invoice).

Lessons cancelled due to technological or logistical issues cannot be refunded or deducted from invoices. These lessons can be postponed to a time which is convenient for both the Institute and the student(s). 


Lessons have to be cancelled per email. 

Lateness

If a student is late, we will wait 10 mins unless we hear from the student informing us about their delay. 

4. Data protection

​We both need to respect each other’s data and rights to privacy. Each of us have agreed to comply with data protection rules set out in the UK GDPR and/or the Data Protection Act 2018. Our Data Protection policy is available on request.

5. Intellectual property 

The methods and materials we use in our lessons involve work we have spent time creating and therefore they are our property, called intellectual property rights. We ask you to respect this as we retain all rights to them.

6. Termination

We hope that this will not arise, but it may be that we have to end this contract, if for example, you have not made payments when due. By our ending it, if it ended due to something you have done, such as failing to pay or breaching these terms, then all outstanding payments become due. Some of the terms here however continue such as confidentiality, data protection and intellectual property rights.

7. General

Neither party shall be in breach of this agreement nor liable for delay in performing, or failure to perform, any of its obligations under it if such delay or failure result from events, circumstances or causes beyond its reasonable control.

Each party undertakes that it shall not at any time or at any time whilst this agreement is in place and for two years after it, disclose to any person any confidential information concerning the business, affairs, customers, clients or suppliers of the other party.

If there is any dispute between us which cannot be resolved by talking it through and it becomes necessary to take legal action, then we both agree that this Agreement will be governed by English law and that any dispute will be exclusively resolved by English Courts to which both parties submit.
